Commercial Property
The Comprehensive Environmental Response Compensation and Liability Act (CERCLA) holds property owners, both past owners and present owners, legally responsible for costs associated with cleaning up environmental contamination. When purchasing a property, the new owner should be aware that they can be liable for clean up costs of a past owners contamination. Many states have enacted regulations requiring disclosure of environmental conditions when commercial, residential or industrial property is transferred. Many lending institutions require a comprehensive appraisal of the environmental status of a property prior to approving financing. It is now common practice for Environmental Site Assessments to be conducted on commercial and industrial property prior to transfer.
Environmental Site Assessments are performed in Phases according to standards set by the American Society for Testing and Materials (ASTM). If a Phase I assessment indicates there are areas of concerns, a Phase II assessment is conducted which may include sampling of soil, water, air or building material. Based on the sampling results a Phase III assessment to evaluate the health risks of the site is commonly conducted by Certified Industrial Hygienist and other specialist. Another type of investigation is for leaking underground storage tanks (LUST). Usually used for petroleum based, fuel oil products but sometimes these tanks held other hazardous material. Greencourse Environmental Remediation can complete these assessments from Phase I historical land use surveys, sampling; all the way through to project managing any required remediation of the site.

Now buyers and lending institutions are requesting environmental assessments on residences. These assessments include items such as lead paint surveys, mold contamination, drinking water quality, asbestos containing building material, as well as radon levels in the air.
